Thank you for using Honcho! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Plastic Labs, Inc. ("Plastic Labs," "we," "us," or "our") regarding your access to and use of the Honcho API and related services (collectively, the "Service").
Honcho is a cloud-based API that provides essential building blocks for AI applications. Our platform connects your applications to storage and AI services, enabling intelligent and contextually aware experiences.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
If you are accessing or using the Service on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms. In such cases, "you" and "your" will refer to that entity.
These Terms incorporate by reference our Privacy Policy, Acceptable Use Policy, and any other policies referenced herein.
Honcho is available in two forms:
The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the Services.
To access the Service you must create an account with accurate information. You must be at least 18 years old to create an Account. Users aged 13‑17 may use the Service only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms, or through an educational institution that has entered into an agreement with Plastic Labs.
You are responsible for maintaining the confidentiality of your API Keys, implementing appropriate security measures, and promptly revoking compromised keys.
You are responsible for all activities under your Account. Plastic Labs is not liable for loss or damage from your failure to secure your Account.
Subject to these Terms, Plastic Labs grants you a limited, non‑exclusive, non‑transferable, revocable license to access and use the API to develop, test, and support your Application and to store and retrieve information using the Service.
Your use is subject to limits described in Documentation or your specific plan. Different usage tiers offer varying features and limits as described at https://www.honcho.dev.
We may release new API versions and will endeavor to maintain backward compatibility with notice of material changes. Data retention periods vary by tier, and you are responsible for backups.
Plastic Labs integrates with third‑party inference and storage providers. We do not guarantee performance or moderation consistency of these services.

Unless specified in a separate Service Level Agreement, the API is provided on an "as available" basis without guarantees regarding uptime, performance, or freedom from errors.
Plastic Labs retains all rights in the Honcho Service and related intellectual property. Nothing in these Terms transfers ownership rights to you beyond the limited license granted.
You retain all rights to your Application and content you provide to the Service.
Plastic Labs will process data according to our Privacy Policy. You grant us licenses to use your Content as necessary to provide the Service.
We maintain strict data segregation between users. You must disclose to your users how their information is processed, obtain necessary consents, implement appropriate security, comply with privacy regulations, and understand that we make no guarantees about third-party service outputs.
You are responsible for configuring appropriate retention periods within your Application, implementing data deletion procedures, and handling privacy requests from your users. Our Service's data retention practices and periods are detailed in our Privacy Policy, which you should review to understand how we manage stored information.
While we implement reasonable security measures, no system is impenetrable. Outputs generated through third-party services may not always be accurate, and you should verify all outputs before relying on them.
If you are accessing or using the Service from regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your information to the United States. By providing your information, you consent to any transfer and processing in accordance with these Terms. You acknowledge that your information may be stored on servers located in the United States and that the United States may have data protection rules that differ from those in your country.
The Service includes a one-time signup credit for new accounts. This free allotment does not reset or renew. Once exhausted, all subsequent usage will be billed according to our published rates. For Enterprise customers, custom payment terms may apply as specified in separate agreements. All fees are non-refundable and exclusive of taxes, which you are responsible for paying.
Plastic Labs may change its fees with at least 30 days' advance notice.
You must notify us of billing disputes within 30 days of the charge.
You may terminate these Terms by closing your Account. Plastic Labs may terminate your access for material violations, security risks, or non-payment with appropriate notice based on your tier level.
Upon termination, all licenses granted to you will end, you must cease using the Service, delete all API Keys, and settle outstanding payment obligations. We will retain your data for 90 days to allow retrieval before permanent deletion.
The following provisions will survive termination of these Terms: Intellectual Property (Section 6), Disclaimer of Warranties (Section 10), Limitation of Liability (Section 11), Indemnification (Section 12), Dispute Resolution (Section 14), and any other provisions that by their nature should survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. PLASTIC LABS DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
PLASTIC LABS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
YOU ACCEPT THAT USE OF API OUTPUTS IS AT YOUR SOLE RISK, AND YOU TAKE FULL RESPONSIBILITY FOR EVALUATING AND MAKING DECISIONS BASED ON SUCH OUTPUTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLASTIC LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. PLASTIC LABS' TOTAL LIABILITY WILL BE LIMITED TO:
You agree to defend, indemnify, and hold harmless Plastic Labs from claims arising from your use of the Service, your Content, your Application, or your violation of these Terms or third-party rights.
Plastic Labs will provide notice of such claims and allow you to control the defense unless we reasonably determine the claim may adversely affect us.
Plastic Labs reserves the right to modify or discontinue the Service at any time without liability.
Plastic Labs may modify these Terms at any time by posting revisions on our website. Your continued use after the effective date constitutes acceptance of the revised Terms. For material changes, we will provide advance notice.
Before filing a claim, you agree to attempt informal resolution by contacting us. Disputes not resolved within 30 days will be settled by binding arbitration conducted by the American Arbitration Association in New York, New York.
YOU AND PLASTIC LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
Disputes related to Intellectual Property Rights, API usage restrictions, or access to the Service may be brought in state and federal courts located in Delaware.
These Terms constitute the entire agreement between you and Plastic Labs regarding the Service.
If any provision is invalid, the remaining provisions will be enforced. Failure to enforce any provision will not constitute a waiver.
You may not assign these Terms without Plastic Labs' consent. Plastic Labs will not be liable for failures beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, labor disputes, or internet service provider failures or delays.

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control (OFAC). You represent and warrant that you are not located in any country or jurisdiction that is subject to U.S. sanctions, not on any restricted or prohibited party list (including the OFAC Specially Designated Nationals List), and will not access or use the Service in violation of any export restriction or embargo.
The open source version of Honcho is governed by the AGPL-3.0. These Terms apply only to the hosted service provided by Plastic Labs.
You acknowledge that storing information about individuals implicates various regulations including privacy laws. While Plastic Labs implements reasonable security measures, our Service is not currently certified for compliance with standards such as SOC 2, HIPAA, or other specialized compliance frameworks. We are actively working toward these certifications, but you remain responsible for ensuring your use of the Service complies with all applicable regulations in your jurisdiction.
